The meeting of the Judicial-Legal Council has been held with presence of judges of the Supreme and appeal courts, General Prosecutor`s Office representatives, Bar representatives, also Baku and other district and city courts judges.
President of the Judicial-Legal Council, the Minister of Justice Mr. Fikrat Mammadov by addressing to in the meeting, emphasized about basic reforms founded by National Leader Haydar Aliyev and are being continued by the President of Azerbaijan Republic Mr. Ilham Aliyev successfully, on measures that raise effectiveness of justice, and told on works done by the Judicial-Legal Council throughout its 5-year activity.
Its noted that, expedient measures were realized by the Council on increasing of effectiveness of justice, on organizing of evaluation of judges` activity and their trainings, pursuant to current state, on increasing demands in executive and labor discipline, on law-breaking, red-tape and removing of negative situations, as well as, the improvement of judiciary and increasing of numbers of judges` staff and etc. issues were proposed according to done analysis.
The new regional appeal and economic courts were established for simplification of citizens referencing to courts, the number of the judges` staff increased till 50 percents and courts` administration staff till 60 percents too. As a result of basic evaluation of judges` corps activity, 38 judges` authority were terminated, also disciplinary proceeding were launched against 22 judges, and 2 courts presidents relieved of their posts.
By establishing the most contemporary and transparent selection of judges in Europe, 157 newly selected and prepared judges appointed to the judiciary posts.
By the way, due to necessity in number of judges staff, the selection of judges were started in 2009 year, and 80 jurists that passed the examinations were drawn into the long-term courses. The courses that held in Academy of Justice, are being carried out by lectures of high instance courts judges, prominent scientist and experienced specialists. Taking into account, the importance of international practice, fortnight trainings were organized for 80 candidates in the Turkey during December of 2009 year.
Done works, as an adopting of Ethical Code of Judges, starting of applying new progressive rules of clerical works in courts, improvement of courts infrastructure, fundamentally and positively effected to the efficiency of justice, and rising of stability of judgments, decreasing of appellation and cassation petitions were seen.
Although, in the meeting there were mentioned about several judges which are still doing serious shortcomings.
In the meeting also mentioned about establishing of judiciary supervision on legality of actions of operational-investigational, preliminary investigation bodies, during realization of judicial reforms launched in the country, and selection of an arrest as preventive punishment was given only to the competence of courts.
Nevertheless, there was defined about non-realizing of judiciary supervision by some judges, and within selection of arrest (the gravest type of preventive punishment) by disregarding provisions of the procedure code, practice of European Court on Human Rights shows the judges approaching to the issue non-principally and formally.
The speech makers, chief of Department on issues regarding to law-enforcement bodies under the Presidental Administration Mr. Fuad Aleskerov, the President of the Supreme Court Mr. Ramiz Rzayev, other members of the Council, the 1st deputy General Prosecutor on investigation Mr. Rustam Usubov, and presidents of appeal courts mentioned about paying of judges` special attention to the selection of an arrest as preventive punishment and changing attitude toward the issue, and judges bear responsibility for protection of human rights.
As a result of discussions held in the session on mentioned theme, Judge of Binagadi District Court Mrs. Rasmiye Gahramanova, Judge of Yasamal District Court Mrs. Sudabe Mammadova, Judge of Sabunchu District Court Mr. Yusif Kerimovs` authorities were terminated, Judge of Binagadi District Court Mrs. Svetlana Ismayilova, and Judge of Yasamal District Court Mrs. Svetlana Ahmadova were transferred to different judicial posts, Judge of Sabail District Court Mr. Famil Nasibov, Judge of Surakhani District Court Mrs. Natavan Tagiyeva, Judge of Azizbeyov District Court Mrs. Fatma Miriyeva, Judge of Yasamal District Court Mr. Abbas Rzayev, Judge of Binagadi District Court Mrs. Sevil Mammadova, Judge of Nizami District Court Mr. Shahin Atakishiyev, Judge of Sumgait City Court Mrs. Shovket Najafova were reproved, and Judge of Yasamal District Court Mr. Khagani Tagiyev, Judge of Sabail District Court Mr. Elnur Hasanov were reprimanded by decision of the Judicial-Legal Council of Azerbaijan Republic.
