The Decree of the President Ilham Aliyev “On deepening of the reforms in the judicial-legal system” on April 3, 2019 is an important “road map” for development of justice and judicial system and systematic measures are being taken on its execution.
Within the framework of the Decree, last year about 40 standard act projects were drafted on organization of new specialized courts, humanization of punishment policy, improvement of civil procedural legislation by taking into account advanced international experience, formation of single judicial experience, improvement of execution of court decisions and forensic examination activity, establishment of their alternative mechanisms, including private executive and expertise organizations and on other issues. A number of new laws have already been adopted at the initiative of the head of state.
As well as, judges` social protection has been significantly strengthened, and judicial support has been improved. Significant works have been done on ensuring the independence of judges, preventing interference in the courts, including inspections and monitoring to strengthen discipline in the courts have been intensified, and for this purpose the hotline and monitoring sectors have been established in the Judicial-Legal Council. About 50 courts have been monitored over the past period, violations have been brought to the attention of more than 100 judges and presidents, and other measures have been taken.
Stable and faster flexible selection of candidates is being made to complete the 200 Judiciary Staffs, which have been enlarged by the Decree of the President, at the expense of lawyers with high training and moral qualities. About 200 lawyers, who have already passed the exams, are taking part in the next stages of the competition.
In addition, new regional commercial and administrative courts have been established to ensure those disputes concerning business activities playing an important role in the development of the economy by judges with deeper legal knowledge and experience. Practical measures have been taken to organize their work, including the territorial jurisdiction, the number of judges and staff was defined, infrastructure issues were solved, and the necessary equipment was provided.
Judges with high theoretical and practical training and experience have been appointed to these courts, which have been operating since the beginning of this year, by the orders of the President on 30.12.2019.
The minister of justice, chairman of the Judicial-Legal Council Fikrat Mammadov, meeting with the judges of new-established courts, stated that the judicial-legal reforms founded by the national leader Heydar Aliyev and successfully realized by the President Ilham Aliyev, serves for formation of high-prestige justice system, reliable provision of judicial protection of human rights, simplification of access by increase of appeals. Emphasizing that, the effectiveness of the judiciary, increasing the confidence and trust of citizens to the justice depends directly on the activities of judges, he brought into notice the head of state`s recommendations on justice, lawfulness, impartiality, transparency, equality and fairness to all judges and chairmen.
It was also stressed that, the important duty of the judges is to ensure the fairness of court decisions, strict adherence to the requirements of the law, the care and proper service to people, and the enhancement of civil satisfaction. Inaccessibility of harsh treatment, harassment, abuse, and non-procedural relations were highlighted, and measures were taken to prevent cases that could discredit the judge`s reputation and prestige.
In this regard, it was noted the importance of taking a serious reaction to each law violation, unhealthy attitude towards negative situations, increasing initiative and principality.
At the meeting attended by the relevant officials of the Ministry of Justice and the Judicial-Legal Council, the cares of new judges and the organization of the works had been interested, discussions were made on the operative solution of the emerging problems and forthcoming duties. Also, specific instructions were given to strengthen the control of labour and enforcement in the newly established courts, holding of regular inspections and monitoring in the courts and citizens` reception at places.
